SCYRA PRIVACY POLICY, SAFETY DISCLAIMER, AND TERMS OF RESPONSIBLE USE

This Privacy Policy, Safety Disclaimer, and Terms of Responsible Use document (“Policy”) applies to the Scyra productivity application and any locally operated Scyra companion application that expressly links to this Policy collectively, “Scyra,” the “App,” “we,” “us,” or “our.”

Scyra is developed and operated by:

Please read this Policy carefully before using Scyra.


PART I — PRIVACY POLICY


1. Our Privacy Principle


Scyra is designed as a local-first productivity application.

The App may process information that you enter, create, or authorize on your device so that Scyra’s features can function. Under the architecture covered by this Policy:

  • Your Scyra information is stored locally on your device.
  • Scyra does not transmit your productivity information to us.
  • We do not operate a cloud database containing your Scyra information.
  • We do not require you to create a Scyra account.
  • We do not use your Scyra information for advertising.
  • We do not sell your personal information.
  • We do not share your Scyra information with data brokers or advertisers.
  • We do not track you across third-party applications or websites.
  • We do not use third-party advertising identifiers.
  • We do not use your Scyra information to create marketing profiles.

Scyra may locally access, calculate, organize, and display information on your device without that information being transmitted to or received by us.


2. Scope of This Policy


This Policy applies only to versions of Scyra that operate entirely or substantially on the user’s device and whose practices match the representations in this Policy.

This Policy does not automatically apply to a future version of Scyra that introduces any of the following:

  • User accounts or authentication;
  • Cloud storage or synchronization;
  • Cross-device data transfer through Scyra-controlled systems;
  • Online leaderboards or social functionality;
  • Developer-operated servers;
  • Remote artificial intelligence processing;
  • Advertising;
  • Behavioral analytics;
  • Third-party crash reporting;
  • Email marketing;
  • Direct payment processing;
  • Public user profiles; or
  • Any other transmission of user information to Scyra or its service providers.

This Policy must be updated before any such feature is introduced.


3. Information Processed Locally by Scyra


Depending on the features you use, Scyra may create, access, calculate, or store the following information locally on your device.


3.1 Productivity and Planning Information

This may include:

  • Flow names, descriptions, durations, start times, and completion times;
  • Flow histories and productivity records;
  • Arc plans, Arc progress, Arc steps, and Arc completion information;
  • Surge settings, targets, timing information, and results;
  • Pulse entries, thoughts, ideas, reflections, and notes;
  • Journey names, tags, categories, and associations;
  • Goals and planning information;
  • Horizon plans;
  • Dreams or archived plans;
  • Notepad content;
  • User-created labels;
  • App preferences and feature settings; and
  • Other information that you voluntarily enter into the App.

This information remains under your control on your device unless you independently export, copy, back up, screenshot, or share it using your device or another service.


3.2 Gamification and Reward Information

Scyra may locally calculate and store:

  • Scyra Score;
  • Points;
  • Pearls;
  • Timed bonuses;
  • Arc multipliers;
  • Movement Points;
  • Streaks;
  • Badges;
  • Creature collections;
  • Creature levels;
  • Creature Mastery records;
  • The Blue progress;
  • Stillwater rewards;
  • Unlocks;
  • Collections;
  • Achievement histories; and
  • Other virtual progress or reward information.

This information is part of the App’s local gameplay and productivity experience. It is not transmitted to us under the architecture covered by this Policy.


3.3 Device Activity and Movement Information

Where you enable movement-related features, Scyra may request permission to access limited activity information, such as step-count information, through an operating-system service such as Android Health Connect, Apple HealthKit, Core Motion, or a comparable device framework.

Scyra uses this information locally to provide user-facing features such as calculating Movement Points or displaying activity-related progress.

Unless a separate disclosure expressly states otherwise:

  • Scyra does not transmit your health or movement information to us;
  • Scyra does not use movement information for advertising;
  • Scyra does not sell movement information;
  • Scyra does not use movement information to make medical decisions;
  • Scyra does not attempt to diagnose your health; and
  • Scyra requests only the categories of information reasonably necessary for the movement feature you choose to use.

You may decline or revoke activity permissions through your device settings. Movement-related features may be unavailable or less accurate when permission is not granted.


3.4 App Settings and Technical State

Scyra may locally store information necessary to operate the App, including:

  • Theme and display preferences;
  • Language preferences;
  • Notification settings;
  • Calm Mode settings;
  • Movement bonus preferences;
  • Feature configuration;
  • Session state;
  • Local database records;
  • Whether an activity is currently in progress;
  • App onboarding status; and
  • Other operational settings.

These settings are stored locally for the purpose of remembering how you configured the App.


4. Information We Do Not Collect Through the App


Under the architecture described in this Policy, we do not receive through Scyra:

  • Your name;
  • Your email address;
  • Your telephone number;
  • Your postal address;
  • Your contacts;
  • Your precise location;
  • Your photographs;
  • Your payment-card information;
  • Your advertising identifier;
  • Your Scyra notes or Pulse content;
  • Your Flow or Arc information;
  • Your Scyra Score;
  • Your Pearls;
  • Your creatures;
  • Your badges;
  • Your movement history;
  • Your health information;
  • Your device browsing history; or
  • A copy of Scyra’s local database.

Scyra does not secretly upload your locally stored content to us.


5. No Advertising, Profiling, or Cross-App Tracking


Scyra does not use locally stored Scyra information to:

  • Deliver targeted advertising;
  • Build advertising profiles;
  • Sell audiences;
  • Track you across third-party applications;
  • Track you across unrelated websites;
  • Determine your eligibility for employment, housing, credit, insurance, or healthcare;
  • Make automated decisions that produce legal or similarly significant effects; or
  • Provide your productivity behavior to data brokers.

Scyra does not display third-party behavioral advertisements under the practices covered by this Policy.


6. Device Permissions


Scyra may request device permissions only when needed to provide a feature you choose to use. Depending on the platform and App version, these permissions may include:


6.1 Notification Permission

Scyra may use local notifications or ongoing notifications to:

  • Show that a Flow, Arc, Surge, or other activity is active;
  • Display timers;
  • Provide locally scheduled reminders;
  • Allow access to session controls; or
  • Inform you of locally determined progress.

These notifications are generated or scheduled locally unless expressly stated otherwise.


6.2 Activity or Health Permission

Scyra may request permission to read limited step-count or activity information for Movement Points or similar user-facing functionality.

You remain in control of this permission through the relevant operating-system health or privacy settings.


6.3 Local Storage

Scyra stores its local database, preferences, and content within storage allocated to the App by your device’s operating system.

Scyra should not request broad access to unrelated files unless a user-initiated import, export, attachment, or backup feature requires it.


6.4 Other Permissions

Any material permission added in the future must be used only for its disclosed user-facing purpose. This Policy must be updated where a new permission changes Scyra’s privacy practices.


7. Information You Voluntarily Send to Us


Scyra does not collect information through the App under the architecture described above. However, you may voluntarily contact us outside the App, such as by sending an email, submitting a store review, reporting a bug, or communicating through a platform operated by another company.

When you voluntarily contact us, we may receive information you choose to provide, such as:

  • Your email address;
  • Your name or display name;
  • The content of your message;
  • Screenshots or recordings you attach;
  • Device or App-version information you include; and
  • Other information contained in your communication.

We will use voluntarily provided support information to respond to you, investigate the matter you reported, protect Scyra, comply with law, or maintain appropriate business records.

Do not include sensitive personal information in a support request unless it is necessary.

Support communications may be processed by the email, app-store, hosting, or communication provider you use. Those providers operate under their own privacy policies.


8. App Stores, Operating Systems, and Independent Third Parties


Scyra may be downloaded, installed, purchased, updated, or operated through services provided by third parties, including Apple, Google, device manufacturers, operating-system providers, payment platforms, or application stores.

Those companies may independently collect or process information such as:

  • App downloads;
  • Purchase transactions;
  • Subscription transactions;
  • Device information;
  • Store account information;
  • Country or region;
  • Technical diagnostics;
  • Crash information;
  • App reviews; and
  • Store usage information.

Such processing may occur independently of Scyra and is governed by the third party’s own terms and privacy policy.

We do not control the independent data practices of your device manufacturer, operating-system provider, internet provider, app store, health-data platform, backup provider, or other third party.

A statement in this Policy that Scyra does not collect information refers to Scyra’s own App-level practices and does not mean that every company involved in distributing or operating your device collects nothing.


9. Local Storage, Security, and Device Access


Your Scyra information is stored locally on your device. Its security therefore depends substantially on the security of your device.

You are responsible for taking reasonable precautions, including:

  • Using a secure device passcode;
  • Enabling device encryption where available;
  • Installing security and operating-system updates;
  • Preventing unauthorized access to your unlocked device;
  • Avoiding untrusted software;
  • Protecting device backups;
  • Using appropriate malware protection where applicable; and
  • Safeguarding any exported Scyra files or screenshots.

No application, storage method, or electronic device can be guaranteed to be perfectly secure.

Someone who gains access to your unlocked device, device backup, operating-system account, or exported files may be able to access your Scyra information.

A compromised, rooted, jailbroken, damaged, or unsupported device may reduce the security or reliability of locally stored information.


10. Retention and Deletion


Because Scyra information is stored locally, it generally remains on your device until one of the following occurs:

  • You delete the relevant information in the App;
  • You reset the relevant Scyra feature;
  • You clear Scyra’s storage through your device settings;
  • You uninstall Scyra;
  • The App performs a disclosed local cleanup operation;
  • Your device or storage is reset, damaged, corrupted, replaced, or lost; or
  • Your operating system removes the information.

Where available, you may delete particular records through Scyra’s editing or deletion controls.

You may generally delete all active local Scyra information by clearing the App’s storage or uninstalling the App. Uninstalling may not delete copies that your operating system, device migration service, or backup provider has independently placed in a backup.

Because we do not possess your locally stored Scyra database, we generally cannot remotely access, recover, export, correct, or delete it for you.


11. Device Backups and Data Migration


Your operating system or another service may include Scyra’s local data in a device backup or device-to-device migration. Whether this occurs depends on your platform, device settings, backup configuration, and the App’s technical configuration.

Any backup maintained by Apple, Google, a device manufacturer, your employer, or another third party is controlled by that provider and is subject to that provider’s privacy and security practices.

Scyra does not guarantee that:

  • Local information will be included in a backup;
  • A backup will remain available;
  • A backup will restore correctly;
  • All Scyra information will migrate to a new device;
  • A restored database will be complete;
  • A future App version will be compatible with an old backup; or
  • Deleted information will immediately disappear from third-party backups.

You are responsible for maintaining any independent records or backups you consider important.


12. Data Loss


Local-first storage offers privacy benefits but creates a meaningful risk of permanent data loss.

You may lose Scyra information because of:

  • Device loss or theft;
  • Device damage;
  • Storage failure;
  • Database corruption;
  • Operating-system error;
  • App error;
  • App uninstallation;
  • Clearing App data;
  • Factory reset;
  • Failed device migration;
  • Failed or incomplete backup;
  • Software update;
  • Incompatible downgrade;
  • User error;
  • Malware;
  • Unauthorized access; or
  • Discontinuation of the App.

Lost information may include Flow history, Pulse content, Arc information, Scyra Score, Pearls, creatures, levels, badges, Mastery progress, plans, settings, and other locally stored content.

Because we do not maintain a server-side copy, we may have no technical ability to restore lost information.


13. Children’s Privacy


Scyra is not directed to children under 13 years of age.

We do not knowingly collect personal information through the App from children under 13. Because the App operates locally under the architecture described in this Policy, we ordinarily do not know the age or identity of individual users.

Parents and guardians are responsible for supervising a minor’s use of Scyra and determining whether the App is appropriate for the minor.

Users who have not reached the age of legal majority in their jurisdiction should use Scyra only with the involvement and permission of a parent or legal guardian.


14. Privacy Rights


Privacy laws in some jurisdictions provide rights concerning personal information held by a business, including rights of access, correction, deletion, restriction, portability, or objection.

Under the architecture described in this Policy, we do not possess your locally stored Scyra content. As a result, we ordinarily cannot:

  • Search for your local Scyra records;
  • Associate local records with your identity;
  • Provide a server-side copy;
  • Correct a local record remotely;
  • Restore deleted content; or
  • Delete information from your device.

You can exercise control over locally stored information through Scyra’s controls, your device settings, clearing App storage, or uninstalling the App.

For information that you voluntarily provide to us outside the App, you may contact us at kingkharnivore@gmail.com regarding an applicable privacy request. We may need enough information to identify the communication and verify that the request relates to you.


15. International Users


Scyra may be available in multiple countries. You are responsible for determining whether your use of the App is lawful in your jurisdiction.

To the extent we receive information through a voluntary support communication, that communication may be processed in the country where we or our service provider operates. We will handle such information as described in this Policy and as required by applicable law.


16. Changes to This Privacy Policy


We may update this Policy to reflect:

  • Changes to Scyra’s features;
  • Changes to technical architecture;
  • Changes to permissions;
  • New legal requirements;
  • New platforms;
  • New third-party services; or
  • Clarifications to existing practices.

The “Last Updated” date will identify the latest version.

Where legally required, we will provide additional notice or obtain consent before materially changing how we process information.

Continued use of Scyra after a revised Policy becomes effective constitutes acknowledgment of the revised Policy to the extent permitted by law.

PART II — SAFETY DISCLAIMER AND TERMS OF RESPONSIBLE USE


18. Acceptance


By downloading, accessing, or using Scyra, you acknowledge that you have read and understood this Safety Disclaimer and Terms of Responsible Use.

If you do not agree, do not use Scyra.

If you use Scyra on behalf of another person or organization, you represent that you have authority to accept these terms on their behalf.


19. Intended Purpose of Scyra


Scyra is a general productivity and personal-organization application with optional collection, progression, timing, and gamification features.

Scyra is intended to help users:

  • Focus on activities they choose;
  • Plan tasks and goals;
  • Record ideas;
  • Organize personal projects;
  • Reflect on completed activities;
  • Build routines;
  • Track locally calculated progress; and
  • Make productivity more enjoyable through optional virtual rewards and collection features.

Scyra does not prescribe what activity you should perform. You are responsible for choosing activities that are safe, lawful, reasonable, and suitable for your circumstances.

Scyra is not intended to encourage overwork, sleep deprivation, physical danger, unsafe speed, obsessive behavior, or neglect of personal responsibilities.


20. Gamification Features


Scyra may use gamified features such as:

  • Scyra Score;
  • Points;
  • Pearls;
  • Bonuses;
  • Multipliers;
  • Timed challenges;
  • Surge;
  • Streaks;
  • Badges;
  • Creatures;
  • Creature levels;
  • Mastery records;
  • Unlocks;
  • Collections; and
  • Progress indicators.

These features are intended to make productivity engaging and enjoyable. They are not intended to pressure users into unsafe, unhealthy, compulsive, obsessive, or excessive behavior.

Different users may respond differently to gamification. Scyra does not guarantee that its reward features will be appropriate for every person or that no user will experience stress, frustration, compulsive use, emotional distress, or unhealthy attachment to virtual progress.

You are responsible for monitoring your own use.

Do not:

  • Continue using Scyra when you are physically or mentally exhausted;
  • Sacrifice necessary sleep to earn points or rewards;
  • Skip meals, medication, medical care, work obligations, education, or personal responsibilities;
  • Ignore physical pain or signs of illness;
  • Perform unnecessary or excessive physical activity to earn Movement Points;
  • Engage in dangerous conduct to complete a timer;
  • Treat Scyra Score as a measure of your personal worth;
  • Compare virtual progress in a way that harms your mental well-being;
  • Use Scyra in a manner that disrupts relationships or daily functioning; or
  • Continue chasing virtual rewards after the activity has become harmful.

Consider reducing or stopping use if Scyra contributes to anxiety, sleep disruption, irritability, neglect of responsibilities, loss of control, repeated unsafe behavior, or distress.

Seek assistance from a qualified healthcare or mental-health professional where appropriate.


21. Scyra Score, Pearls, and Virtual Items Have No Monetary Value


Unless Scyra expressly states otherwise in legally binding purchase terms:

  • Scyra Score is not money;
  • Pearls are not money;
  • Points are not money;
  • Creatures are not property with cash value;
  • Badges are not property with cash value;
  • Levels and Mastery records are not property with cash value;
  • Virtual rewards cannot be redeemed for legal tender;
  • Virtual rewards do not represent an investment;
  • Virtual rewards do not create an ownership interest in Scyra; and
  • Virtual rewards are not a bank account, security, cryptocurrency, stored-value instrument, or financial product.

Virtual balances and collections exist only as part of Scyra’s local experience.

No user should undertake financial, physical, professional, or personal risk because of a desire to obtain or preserve a virtual reward.


22. Surge and Other Timed Features


Surge and other timed features may encourage users to complete a self-selected activity within a chosen period. These features are productivity tools, not instructions to move dangerously or ignore your environment.

A timer never takes priority over safety.

You must not attempt to beat a Surge time or other Scyra timer while:

  • Driving;
  • Operating a motorcycle, bicycle, scooter, or other vehicle;
  • Operating machinery;
  • Crossing a road;
  • Walking near traffic;
  • Using stairs or escalators where distraction could cause injury;
  • Near water, fire, heights, sharp objects, or hazardous materials;
  • Cooking in circumstances requiring close attention;
  • Caring for a child, patient, animal, or dependent;
  • Performing medical, industrial, electrical, construction, or laboratory work;
  • Participating in an activity that legally requires undivided attention;
  • Performing an activity for which rushing increases risk;
  • In a crowded public environment where distraction could harm others; or
  • In any situation where looking at or responding to a device is unsafe.

Do not run, rush, speed, skip required safety procedures, take shortcuts, ignore warnings, or violate laws to improve a Surge result.

Pause, stop, or abandon the Surge whenever conditions become unsafe. No Scyra reward is worth personal injury, property damage, legal consequences, or harm to another person.

You are solely responsible for choosing reasonable targets and determining whether an activity can safely be timed.


23. Movement Points and Physical Activity


Movement Points and similar features are intended as optional engagement features. They are not exercise prescriptions or medical recommendations.

Step counts and movement estimates may be incomplete or inaccurate because of:

  • Device limitations;
  • Sensor error;
  • Permission settings;
  • Delayed synchronization;
  • Device placement;
  • Operating-system restrictions;
  • Battery optimization;
  • Duplicate records;
  • Missing records; or
  • Differences between devices and platforms.

Do not rely on Scyra for medical monitoring, rehabilitation, emergency detection, athletic qualification, workplace safety, or any purpose where inaccurate activity information could cause harm.

Do not perform excessive activity merely to obtain points.

Before beginning or increasing physical activity, consider your health, environment, footwear, weather, mobility, medical history, and the advice of an appropriate professional.

Stop physical activity and seek appropriate assistance if you experience pain, dizziness, faintness, chest discomfort, difficulty breathing, confusion, unusual weakness, or another concerning symptom.


24. Breathing, Mindfulness, and Focus Exercises


Scyra may provide general breathing, grounding, mindfulness, or focus exercises.

These exercises are offered for general wellness and productivity purposes only. They are not:

  • Medical treatment;
  • Mental-health treatment;
  • Psychotherapy;
  • Crisis intervention;
  • Respiratory therapy;
  • A substitute for professional care; or
  • A diagnosis of any condition.

Some users may experience discomfort, dizziness, anxiety, panic, emotional activation, or other adverse reactions during breathing or mindfulness exercises.

Stop immediately if an exercise causes discomfort or distress. Resume normal breathing and seek appropriate assistance where necessary.

Users with respiratory, cardiovascular, neurological, psychiatric, pregnancy-related, or other relevant medical considerations should consult an appropriate professional before using exercises that could affect them.

Scyra is not an emergency service. Do not rely on the App during a medical or mental-health emergency.


25. No Medical, Psychological, Legal, Financial, or Professional Advice


Scyra provides general productivity tools and informational content. It does not provide medical, psychological, psychiatric, legal, financial, employment, educational, or other licensed professional advice.

Nothing in Scyra creates a professional-client, doctor-patient, therapist-patient, attorney-client, fiduciary, or similar relationship.

Consult a qualified professional regarding decisions that require professional judgment.


26. User Responsibility


You are responsible for:

  • Selecting safe and lawful activities;
  • Setting reasonable goals;
  • Choosing reasonable durations;
  • Taking breaks;
  • Getting adequate sleep;
  • Maintaining proper hydration and nutrition;
  • Following workplace and school rules;
  • Following traffic and safety laws;
  • Following medical advice;
  • Protecting your device;
  • Maintaining appropriate backups;
  • Monitoring your use of gamification;
  • Stopping when use becomes harmful;
  • Supervising use by minors; and
  • Considering the safety of other people.

Scyra does not supervise your conduct and cannot determine whether a particular activity is safe for you.

Do not use Scyra to plan, encourage, document, or facilitate unlawful conduct or harm to yourself or another person.


27. Assumption of Risk


You voluntarily choose whether, when, where, and how to use Scyra.

To the fullest extent permitted by applicable law, you assume the risks associated with:

  • Distraction caused by device use;
  • Rushing to complete a timed activity;
  • Physical exertion;
  • Excessive use;
  • Compulsive pursuit of virtual rewards;
  • Reliance on inaccurate timers or calculations;
  • Loss of locally stored data;
  • Device malfunction;
  • Use in an unsafe environment;
  • Failure to take appropriate breaks;
  • Failure to follow professional advice; and
  • Activities you independently choose to perform.

This provision does not waive rights or remedies that cannot legally be waived.


28. Data-Loss Disclaimer


Scyra’s local-first architecture means we may not possess a recoverable copy of your information.

You acknowledge that Flow histories, Pulse entries, Arc plans, Scyra Score, Pearls, creatures, levels, badges, Mastery records, goals, notes, settings, and other content may be permanently lost.

To the fullest extent permitted by law, we are not responsible for losses resulting from:

  • Uninstalling Scyra;
  • Clearing application data;
  • Device replacement;
  • Device loss;
  • Device theft;
  • Device damage;
  • Storage corruption;
  • Failed backup;
  • Failed restoration;
  • Failed migration;
  • Operating-system updates;
  • App updates;
  • Software defects;
  • Unsupported modifications;
  • Rooting or jailbreaking;
  • Malware;
  • Unauthorized device access;
  • User error; or
  • Events outside our reasonable control.

You are responsible for maintaining any independent backup or record that you consider necessary.

Scyra does not guarantee that lost points, Pearls, creatures, badges, levels, Mastery records, or other virtual progress can be restored or recreated.


29. Accuracy of Scores, Rewards, and Timers


Scyra does not guarantee that any score, reward, timer, step count, multiplier, streak, level, badge, or virtual balance will be calculated or displayed without error.

Errors may result from:

  • Software bugs;
  • Clock changes;
  • Time-zone changes;
  • Device restarts;
  • Background-process restrictions;
  • Interrupted sessions;
  • Permission changes;
  • Database corruption;
  • Sensor limitations;
  • Operating-system behavior;
  • Device-specific limitations; or
  • Feature updates.

Scyra may correct calculation errors, modify reward formulas, adjust feature behavior, or discontinue a feature in a future version.

Virtual progress should not be relied upon as an official record of work, attendance, billing, fitness, productivity, employment performance, academic performance, or contractual compliance.


30. Application Availability


Scyra may be changed, updated, suspended, or discontinued.

We do not guarantee that:

  • Every feature will always remain available;
  • Scyra will work on every device;
  • Scyra will remain compatible with every operating-system version;
  • Updates will preserve every local record;
  • Every defect will be corrected;
  • Timers will run without interruption;
  • Notifications will always appear;
  • Local data will never become corrupted; or
  • The App will meet every user’s expectations.

31. Disclaimer of Warranties


To the fullest extent permitted by applicable law, Scyra is provided on an “as is” and “as available” basis.

We disclaim all express, implied, and statutory warranties, including warranties of:

  • Merchantability;
  • Fitness for a particular purpose;
  • Accuracy;
  • Reliability;
  • Availability;
  • Security;
  • Non-infringement;
  • Quiet enjoyment;
  • Data preservation;
  • Error-free operation; and
  • Suitability for your physical or psychological circumstances.

We do not warrant that Scyra will increase productivity, improve health, establish habits, prevent distraction, reduce stress, or produce any particular result.

Some jurisdictions do not permit the exclusion of certain warranties. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.


32. Limitation of Liability


To the fullest extent permitted by applicable law, Rajas Kharkar, Scyra, its owners, developers, officers, employees, contractors, affiliates, licensors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to Scyra.

This includes, without limitation:

  • Loss of data;
  • Loss of Scyra Score;
  • Loss of Points or Pearls;
  • Loss of creatures, levels, badges, or Mastery records;
  • Loss of productivity;
  • Lost profits;
  • Lost opportunities;
  • Business interruption;
  • Device damage;
  • Property damage;
  • Emotional distress;
  • Compulsive or excessive use;
  • Personal injury arising from user-selected conduct;
  • Harm caused by rushing or distraction;
  • Reliance on inaccurate information;
  • Failure of notifications;
  • Failure of backups; or
  • Inability to access Scyra.

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to Scyra will not exceed the greater of:

  1. The amount you paid directly for Scyra during the twelve months immediately preceding the event giving rise to the claim; or
  2. The minimum amount of liability that applicable law does not permit us to exclude.

This limitation applies regardless of the legal theory asserted, including contract, warranty, negligence, tort, strict liability, statute, or otherwise, and even if we were advised that damages were possible.

Nothing in this Policy excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where such liability cannot legally be excluded, or any other liability that applicable law prohibits us from excluding.


33. Third-Party Devices and Services


Scyra may depend on operating systems, app stores, device sensors, health-data frameworks, notification services, or other third-party components.

We are not responsible for the availability, accuracy, security, policies, or operation of third-party products and services.

Your use of those products and services is governed by their respective terms and policies.


34. Minors


A parent or legal guardian who permits a minor to use Scyra is responsible for:

  • Supervising that use;
  • Determining whether gamification is appropriate;
  • Setting reasonable limits;
  • Preventing unsafe timed activities;
  • Monitoring signs of distress or excessive use; and
  • Ensuring the minor follows this Policy.

Scyra should not be used by a minor in a manner that interferes with sleep, education, health, family obligations, or safety.


35. Governing Law


This Policy and any dispute relating to Scyra will be governed by the laws of Maharashtra, India, without regard to conflict-of-law principles, except where the mandatory law of the user’s jurisdiction applies.

Subject to any non-waivable consumer rights, the courts located in Pune, Maharshtra, India will have exclusive jurisdiction over disputes arising from or relating to Scyra.

This section should be completed and reviewed by qualified legal counsel before publication.


36. Severability


If any provision of this Policy is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.


37. No Waiver


A failure to enforce a provision of this Policy is not a waiver of the right to enforce that provision or another provision later.


38. Entire Document and Additional Terms


This document contains Scyra’s Privacy Policy and general Safety Disclaimer and Terms of Responsible Use.

Additional terms may apply to:

  • Paid purchases;
  • Subscriptions;
  • Promotional programs;
  • Beta testing;
  • Separate online services;
  • Cloud functionality;
  • Accounts; or
  • Future features.

Where additional terms conflict with this document, the more specific terms will control for the relevant feature, except where prohibited by law.


39. Changes to the Disclaimer


We may update this Safety Disclaimer and Terms of Responsible Use as Scyra changes.

Material changes may be communicated through the App, the App’s store listing, or another appropriate method.

Your continued use after the effective date of an updated version constitutes acceptance to the extent permitted by law.
